Q: How do I file papers with NJBPU?

A: The best way to file papers with NJBPU is through e-Filing. Instructions on e-Filing are available here.

 

  • Current e-Filing Users: Entities registered in the Board’s e-Filing pilot program may continue to file documents in the same manner.
  • New e-Filing Users: Entities who are not part of the e-Filing pilot may electronically file documents with the Board upon following the instructions available here.
  • Email Filing: Entities may file documents with the Board Secretary by emailing board.secretary@bpu.nj.gov.
  • Hard Copies Discouraged: While you may continue to mail documents to the agency, due to limited access to the building, documents will not be processed or deemed filed until after the Board reestablishes normal operations. 

 

Q: Some of my documents are confidential. How do I file them privately with the Board?

A: Documents may be filed confidentially according to the filing method as follows:

 

  • e-Filing: Entities may e-File confidential documents following the Instructions available by clicking here.
  • Email Filing: Entities that are filing via email may submit confidential or proprietary information via email to the Board Secretary at board.secretary@bpu.nj.gov. Please include “CONFIDENTIAL INFORMATION” in the subject line of the email.

Please note that parties seeking confidential treatment must continue to meet the requirements set forth in the Board Rules, with the exception of paper filings and mailings pursuant to N.J.A.C. 14:1-12.1 et seq. Please see the Q&A below regarding notarization of documents.  

 

Q: How will I know my filing is complete?

A: Entities will receive the following confirmation according to the filing method as follows:

  • E-Filing: Parties utilizing the e-Filing system will receive an email acknowledging receipt.
  • Email Filing: Members of the public filing with the Board Secretary via email at board.secretary@bpu.nj.gov will receive a receipt of confirmation when the document is received.

A document shall be considered filed with the Board once the party receives an electronic confirmation of the filing. Filers will be notified of any deficiencies in the filing.

 

Q: I do not have the ability to electronically file my papers.  What do I do?

A: If you do not have access to email, you may contact NJBPU’s Customer Service hotline at 800-624-0241. Please leave a voicemail and a member of our Staff will return your call shortly.

 

Q: How do I pay the associated fees with my electronic filing?

A: The Board’s March 19, 2020 Order specified that collection of filing fees is suspended until NJBPU resumes normal operations. Suspended filing fees will be due at a future date to be determined by the Board.

 

Q: Am I required to submit a notarized statement as required by some of the Board’s regulations?

A: Yes. The legislation concerning remote notarial acts can be found here.

 

Q: May I submit an electronic filing into the record of a formal proceeding? 

A: Yes. As per the March 19, 2020 Order, the Board waived the prohibition on the submission of electronic document from being entered into the record of a formal proceeding, as set forth in N.J.A.C. 14:1-1.1 et seq. and N.J.A.C. 14:17-1.1 et seq.

 

Q: How do I get access to the activity on a case?

A: You will gain access to the activity on a case you are a party to through the NJBPU External Access Portal once you establish a MYNJPortal account.

 

Q: How do I search for documents if I don’t have the docket number?

A: The NJBPU Public Document Search Tool allows a user to search by document title, party, and keyword. A Users Guide for this tool is available here.

 

Q: If I e-File comments pursuant to a Board Order or stakeholder meeting, where can I view the comments?

A: Users can view comments by conducting a Public Document Search here.  

 

Q: Will parties represented on the Service List receive a copy of the e-Filed documents upon upload?

A: No, as is the case with hard copy filings and email filings, it is the filer’s responsibility to provide notice to parties on the service list of the filing.
